Hisbah seeks to dissolve marriage between man, grand-daughter

The Hisbah Commission in Zamfara state has asked a Sharia Court to divorce the marriage between Musa Tsafe, 47, and his grand-daughter, Wasila Isah.

Wasila, according to the story, is the grand-daughter of Tsafe’s elder brother. The couple got married in 1999, amid opposition from family members who believe the liaison contradicted certain Islamic injunctions. Due to the controversy, Tsafe and Wasila eloped to Kaduna, and they have had eight children.

Tsafe and Wasila returned to Zamfara recently and were greeted with the initial opposition to the marriage.

Concerned relations decided to report the matter to the Tsafe Emirate Council, which, in turn forwarded it Shura Council (of Tsafe local government). The council, after consulting the Holy Qur’an and other books of Islamic Jurisprudence, recommended Tsafe divorce Wasilu quietly and to also offer her alimony for her sustenance.

Tsafe was said to be disposed to separating from Wasila when he realised the Hisbah commission had filed a case against the marriage before the sharia court. Angered, Tsafe decided to backtrack on his plan to divorce Wasila.

Lawal Muhammad Dankamfani, the chairman of Hizbah commission for the local government, said they decided to sue Tsafe because he was unwilling to separate from Wasila,

“The case was taken to sharia court after the husband refused to end the union and the Hizbah want the court to dissolve the marriage because it is against the Islamic injunctions,” he said.

The couple are said to have shunned repeated summons to appear before the court.

On Thursday, the prosecuting counsel, Barr Sani Muhammad, urged the court to dissolve the union, a move opposed by the defence counsel, Barrister Abubakar Ayuba.

Ayuba pleaded for time to enable him investigate the action taken by the Hisbah commission. He also argued that the court lacked jurisdiction to entertain the case. The judge adjourned the case until July 25, 2022.
