2023: Emefiele loses bid to stop CBN board, INEC

A Delta State High Court sitting in Kwale has vacated its order restraining the Board of the Central Bank of Nigeria from removing Governor Godwin Emefiele over his 2023 political ambition.

The court, on May 5, granted Emefiele’s requests including barring the Independent National Electoral Commission (INEC). The governor of Nigeria’s apex bank is aiming the highest office under the banner of the All Progressives Congress (APC).

Chidi Odinkalu, a rights activist and former chairman of the National Human Rights Commission (NHRC), posted court document stating the withdrawal of the order.

In the document sighted by TheCornet, Justice D.C Maidoh said the seven days validity of the order had lapsed. The judge also said that since the plaintiffs did not file for extension, the order “is deemed vacated and set aside.”

Justice Maidoh adds that the new practice guidelines issued by the National Judicial Commission (NJC) requires that she send the case to the chief judge of Delta State for assignment.

The judge also warned the plaintiff’s counsel against misleading the court.

“It is needful to state that counsels, in seeking interim orders of the court, are ministers in the temple of justice and have a duty to present all facts and refrain from suppressing any facts that may aid the court in its judicial assignment, the judge stated.”
