Obi’s petition against Tinubu non-starter – Clark

Chief Robert Clark, a senior lawyer, has stated his misgiving about the petition filed by Labour Party’s candidate Peter Obi. Clark, in an interview broadcast on Arise television, described Obi’s petition challenging the presidential election outcome as “a non-starter”.

The electoral umpire had declared Bola Tinubu of the ruling All Progressives Congress (APC) the winner of the poll, which each of the opposition candidates is equally claiming to have won.

In his analysis, Clark faulted the argument that INEC should not have declared Tinubu the winner because he did not score two-third of votes cast in Abuja, the nation’s federal capital. He stated that the tribunal would have to determine the implication of the constitutional provision that a candidate could be said to have won, if he scored two-third votes in 36 states and Abuja.

He said, “The question to be considered by the tribunal is what constitutes ‘2/3 of the 36 states and Abuja’ and how do you construct that word, “and”.

“Do you take 36 states first and then take Abuja”, he asked rhetorically.

Clark added, “Does that make a sense. Does that give any good reason for democracy to survive. No.”

Equally, Clark also said Obi would not make a “headway” on the other ground bordering on Tinubu’s forfeiture of large sum of money over a drug-related issue in the U.S.

He said, “That issue has been settled; the labour party can never make any headway on that ground.”
