Abba Kyari loses bid to quash drug charges

The Federal High Court has dismissed an application filed by under-trial police officer, Abba Kyari against his trial. Kyari, based on his application, said that the National Drug Law Enforcement Agency ought to have waited out the outcome of police investigation into the matter before filing charges against him. He also said that the National Police Commission, like the National Judicial Commission, is vested with powers to discipline an errant police officer. Kyari believes his arraignment is misplaced and ought not to be.

The trial judge, Emeka Nwite, dismissed the application and affirmed the court’s jurisdiction to hear the charges against the suspects. He cited Section 251 of the constitution as conferring on the court the jurisdictional powers to hear the drug-related suits.

The police had suspended Kyari-a deputy commissioner of police-and his accomplices over their indictment for drug pushing.  Others co-accused are ACP Sunday J. Ubua, ASP Bawa James, Inspector Simon Agirgba and Inspector John Nuhu. The NDLEA claimed the accused conspired to sell 17.55kg of seized cocaine. They are also accused of tampering with evidence, to wit 21.35kg of cocaine which the NDLEA seized from two convicted drug dealers.
