Uncertainty shrouds PDP’s Adebutu’s candidacy as C’ Appeal orders hearing

The Court of Appeal sitting in Federal Capital Territory, Abuja, has asked that the Federal High Court hears the governorship candidacy dispute in Ogun state chapter of the Peoples Democratic Party (PDP).

An aspirant Jimi Lawal had filed a lawsuit against Oladipupo Adebutu nomination as the party’s governorship candidate for the state. The then trial judge, Taiwo Taiwo (now retired), ruled that the court lacked jurisdiction to hear the matter. He therefore dismissed the suit.

Dissatisfied, Lawal filed an appeal against ruling, resulting in the latest judgment.

The appeal court justices, led by Biobele George, held that the matter was a pre-election case and that the court had jurisdiction to hear it. They, therefore, asked that the case file be sent to the chief judge for the matter to be reassigned and heard on its merit.

TheCorner reports that the litigant, Lawal had questioned the delegates list used for the primary election that produced Adebutu.
