Tinubu, Atiku, Obi sued over their vice presidential candidates

Presidential candidates Bola Tinubu, Abubakar Atiku, and Peter Obi have been sued before a Federal High Court over their vice presidential nominees.

Three lawyers filed the suit, in which they see to bar INEC from accepting the nominations of the three presidential hopefuls. The lawyers are Ataguba Aboje, Oghenovo Otemu and Ahmed Yusuf.

Other defendants are INEC, the Attorney General of the Federation ( AGF), All Progressives Congress ( APC), People’s Democratic Party ( PDP) and Labour Party (LP) as 1st to 5th respectively.

The plaintiffs argue the affected political parties ought to have nominated their vice presidential candidates along with their standard-bearers, before conducting their primaries.  They also state that the actions of the three parties contravene the provisions of the 1999 Constitution and the Electoral Act, 2022,

The plantiffs also urge the court to determine whether the office of the Vice President of Nigeria is an elective office subject to the same qualification as the office of the President of Nigeria, based on the provisions of Sections 131, 141 and 142 of the 1999 Constitution.

Equally, they are also asking the court to determine whether a political party must nominate vice presidential candidate before such can stand for election, and whether such nomination should be done before the political party conducts its primaries.

The lawyers wants the court to determine the foregoing issue based on the provisions of Sections 131, 141 and 142 of the Constitution and Sections 29, 32, 84 and 152 of the Electoral Act, 2022.
