Abba Kyari has asked a federal court to grant him a bail to order his release from the detention of the National Drug Law Enforcement Agency, NDLEA.
The police had suspended Kyari over his alleged involvement in Cyber fraud and he his currently detained for drug dealing.
Kyari, in the suit, is seeking his release on health grounds and pending the determination of his fundamental right suit.
Cynthia Ikena, who is Kyari’s counsel, said his client is suffering diabetes and hypertension.
In her ruling, Justice Inyang Ekwo failed to grant the order and rather urged the plaintiff to put the Federal Government on notice.
“Upon studying the process of the Applicant and averments in support thereon, I am of the opinion that the respondent should be put on notice,” the judge held.
Justice Ekwo also ordered that all the relevant processes should be served on FG, the sole respondent in the suit.
She adjourned hearing till February 24.
