Judge restrains EFCC over unlawful act

Justice Inyang Ekwo of the federal high court, Abuja, has restrained the Economic and Financial Crimes Commission (EFCC) from taking further action against Fezel Nigeria Limited.

The anti-graft agency had sealed the Abuja-based company. Delivering his ruling, Justice Ekwo faulted EFCC’s action, citing a breach of the plaintiff’s constitutional rights.

He said the action of the anti-graft agency amount a violation of the rights of the plaintiff to own property as enshrined in section 43 of the 1999 Constitution.

As a result, the judge slammed a fine of N1 million naira against the EFCC.
