Emefiele’s arrest by DSS illegal – Falana

Femi Falana, (SAN), has faulted the Department of State Services’ (DSS)  arrest and investigation of suspended Central Bank of Nigeria governor Godwin Emefiele.

The secret police had arrested and accused Emefiele of terrorism financing after President Bola Tinubu suspended him from office.

The lawyer and human rights crusader (Falana) said the Economic and Financial Crimes Commission (EFCC), rather than the DSS, ought to investigate Emefiele for the alleged financial crimes levelled against him

Falana cited the Supreme Court ruling of wrongful prosecution of Senator Bukola Saraki for failure to declare his assets. He said the court found that the Code of Conduct, and not the EFCC should prosecute Saraki and, based on that, discharged him.

“It was for that principal reason that Senator Saraki was freed by the apex court.

“In line with the principle of law enunciated by the apex court in Saraki’s case, the SSS lacks the power to investigate and prosecute Mr Emefiele  in respect of allegations of money laundering and other economic crimes,”, the lawyer stated.
