DSS attempt to arrest Emefiele vindictive, embarrassing – Judge 

Justice M. A Hassan of the Federal High Court, Abuja, Thursday declared the attempt to arrest Central Bank of Nigeria Governor Godwin Emefiele ‘vindictive’ and ’embarrassing’, among other things.

A not-for-profit, the Incorporated Trustees of Forum for Accountability and Good Leadership (ITFAGL), filed the suit before Justice Hassan against the Department of State Security (DSS), who is accusing Emefiele’s arrest for alleged terrorism financing.

Justice Hassan gave a similar ruling as Justice John Tsoho, who had earlier rejected the DSS application for an order to arrest Emefiele.

In the latest ruling, Justice Hassan described the allegations against Emefiele as trump-up, adding the DSS “acted wrongfully and illegally in instigating the President of the Federal Republic of Nigeria against Mr. Godwin Emefiele in respect of the exercise of his statutory duty relating to the issuance of monetary policies and directives in the interest of the National Security and economy”.

He was also definitive in declaring the accusations of terrorism financing and fraudulent practices as constituting “a flagrant breach of his (Emefiele’s) rights to personal liberty, dignity of human person, right to policy making powers, freedom of thought, conscience and religion and movement”

The DSS’ case was made worse by the denial by the Economic and Financial Crimes Commission (EFCC) that it had a case against Emefiele.

The judge, delivering his verdict, restrained the DSS and its agents from taking steps to arrest, detain or restrict the movement of the Central Bank of Nigeria (CBN’s) governor.
